DOJ complaint
The U.S. Department of Justice complaint contains various photographs from security cameras located inside and outside of the Capitol building showing Milavec participating in the Jan. 6, 2021 riot.
The criminal complaint states that video footage posted on social media titled “Battle over Northeast entrance to U.S. Capitol on January 6” captured Milavec, wearing a red “Make America Great Again” cap, “entering the U.S. Capitol with a group of rioters,” according to the complaint.
“Milavec entered the Capitol together with an individual subsequently identified as her son-in-law, Craig Jackson Moore (“Moore”), who was carrying a large backpack, wearing a dark gray sweatshirt, and wearing a gray and black baseball hat,” stated the complaint.
Closed-circuit video recorded inside the Capitol shows both Milavec and Moore entering a corridor at 3:11 p.m. on Jan. 6, 2021.
“Inside the Capitol, Milavec and Moore joined a mob that confronted a group of police officers, including officers in riot gear, who formed a line to try to prevent the rioters from further advancing into the Capitol,” according to the complaint. “Within approximately two minutes, police used physical force to expel the rioters from the corridor.”
Milavec and Moore left the building after visibly experiencing the effects of tear gas, the complaint stated.
FBI investigation
The Federal Bureau of Investigation records show that Milavec booked a ticket to fly from Austin to Atlanta with a connecting flight to Washington, D.C., on Jan. 4, 2021 and a return flight from Baltimore, Maryland, departing Jan. 6, 2021 at 7:25 p.m. Records further stated that she boarded the flights.
An FBI investigation found an internet post allegedly written by Milavec on Feb. 14, 2021, at 7:06 a.m., stating: “I, like so many others, were in DC on Jan 6 and have been wrongly portrayed as a violent maniac. I will not sit down and let my country be taken by stealing, corrupt, ungodly people – but I will always seek God’s way to pursue the truth.”
Milavec’s attorney, Jennifer Freel, said she does not comment on pending cases.
Milavec’s hearing in the District of Columbia is scheduled for 12:30 p.m., Thursday, May 23 via Zoom.
The conditions of Milavec’s release from jail set by with the U.S. District Attorney’s Office, Western District of Texas specified that Milavec surrender her passport and restrict her travel to Gillespie, Travis, Hays and Williamson counties with no foreign travel. Milavec may travel to Washington, D.C. for court appearances.
